【摘要】 我国地方立法分为普通行政单位立法、民族自治地方立法、经济特区地方立法和特别行政区立法。四种不同法域的地方立法反映了单一制国家在中央集权体制下的多元立法的权力分工协调机制。但在实践中,这种立法体制却存在诸多问题,四种法域的地方立法与中央立法均存在不同程度的冲突,地方立法之间亦有诸多问题,立法权的分散也与WTO的统一性要求相背离。更多还原

【Abstract】 In China, there are four different kinds of local legislation including common administrative department legislation, self\|control nation area legislation, preferential economy area legislation and special administrative area legislation. Those inflect the privilege\|dividing and coordinating mechanism in the country under the centralization of authority. However, these kinds of legislation show several problems in actual practice. Conflicts remain not only between those four sorts of local legislation and central legislation but also between themselves. The dispersal of legislative authority is also aberrant from the unification requirement of WTO. In this paper, we discuss about those practical problems and offer some improvements.更多还原
