【摘要】 GATT对人类、动植物生命健康保护的条款体现在第 2 0条 (b)之中 ,但是 ,由于此款规定的含糊 ,导致了很多贸易争端。乌拉圭回合达成的《动植物卫生检疫措施协议》(SPS协议 )在法律上是对此款的一个补充。然而 ,在应用该协议的贸易实践中 ,发生诸多争端 ,反映了该协议存在着诸多漏洞。对这些漏洞进行分析有着重要意义。本文结合近期发生的一些案例 ,分析了协议中发生争端的一些条款并提出了中国应用这些条款的一些对策。更多还原

【Abstract】 The protection of GATT on human being, animals and plants life and health is stated in Article 20(b). But it caused many trade disputes because of the ambiguity stipulation of this article. In Uruguay Round, animal and plant health quarantine measure agreement was reached(SPS Agreement),which is the leagle supplement for this article. However, in the trading practice of applying this agreement, there are a lot of disputes, which mean that there are many loopholes on this article. So it is important to analyze these loopholes. In the thesis the authors analyzed some articles with disputes in this agreement and studied some present cases. They put forward some measures that can be applied in China.[更多还原
