【摘要】 最密切联系理论是当代国际私法中最有影响的一种法律适用理论。它改变了传统的国际私法僵硬、机械的法律选择方式,赋予冲突规范以极大的灵活性和适应性。该理论在法律选择中的适用,最大限度地体现了立法者和司法者及当事人追求法律正义和利益平衡的愿望。文章通过对最密切联系理论在法律选择过程中特殊地位的分析,试图阐明在处理涉外案件中,根据该理论选择的法律最能体现对公平、正义、灵活、合理的价值取向的追求。更多还原

【Abstract】 Closest connection theory is one of the most influential legal application theories in contemporary private international laws.This theory,allowing conflict rules for greatest flexibility and adaptability,alters the choice rules of the traditional private international laws by changing its rigidity and mechanics.The choice of this rule finds an expression for legislator,juicier and party’s desires for legal justice and interest balance.This paper,analyzing its special roles in law choice process,attempt to formulate that,in the process of dealing with international civil and commercial cases,law choices by the closest connection theory can best signify the pursuit of fair,just,flexible and reasonable values.更多还原
