【摘要】 监视居住在司法实践中存在着适用空间狭窄和执行效果差的问题,在诉讼价值方面其内在价值和经济效益价值也不统一,因而造成了监视居住陷于存废两难境地的尴尬局面。要解决这一难题,从监视居住制度本身并不能找到答案,而应在取消监视居住制度的同时通过增加取保候审的保证类型来达到目的。更多还原

【Abstract】 In judicial practices, Residence - Under - Surveillance brings about serious problems, such as narrow scope of application and ineffective implementation. With regard to the contentious value, the inner value of Residence - Under - Surveillance can’t match the value of economic benefits. Consequently, Residence- Under- Surveillance is in a dilemma of existence or abolishment. To solve this problem, people will never find the answer in the system of Residence - Under - Surveillance, but they should increase the guarantee types of bail to attain the aim while abolishing the system.更多还原
