【摘要】 虽然诱惑侦查对一些特殊案件的侦破有很大价值,但是侦查机关在哪些情况下可以进行诱惑侦查行为,哪些情况下不能进行,在哪些情况下侦查人员违反法律规定进行诱惑侦查行为可能构成滥用职权罪等问题,都还有必要深入探讨。对于被诱惑者的刑事责任问题,应该区别情况,分别对待只有在被诱惑者被诱惑之前已经进行了部分犯罪行为,并且侦查人员的诱惑行为没有突破社会道德底线的情况下,被诱惑者才负犯罪预备或者犯罪未遂的刑事责任。更多还原

【Abstract】 Although encouragement is valuable in investigation of unusual case, but it is still necessary to discuss the following questions: in which circumstance policemen can carry out encouragement, and in which circumstance their encouragement is misuse of authority. As for the penal liability of the one who is encouraged, "subsection theory" and "social policy theory" can be applied to. According to these theories, the one who is encouraged to bear penal liability only if he already has done part of criminal act and the encouragement does not break through the social moral base line.更多还原
