【摘要】 通过对山东省邹城市村镇人民调解制度的实地调查,总结出新的民间纠纷具有主体多元、类型多样、注重利益、易激性等特点,分析了由镇调解中心、管区调解站、村调解委员会构成的各级组织形式,总结了"十户三员"、"民情恳谈"、"评理会"等制度创新;阐述了现行调解制度产生的原因、优越性;对人民调解委员会提出定位为基层政府指导下的民间组织、专事调解民间纠纷、合法调解协议书应具有法律效力等修改法律的建议。更多还原

【Abstract】 Through the spot investigation into the people′s mediation system in towns and villages of Zoucheng, Shandong Province, we find the new civil disputes are characterized by the diversity of parties and types, the emphasis on interests and the tendency of being easily intensified. In this article, we analyze the organizing form consists of the mediation center of the town, the mediation station of the section and the mediation committee of the village. There are some innovations such as the systems of three persons every ten families, communion of situation of the people and the committee which judge who is right. And we expound the reason why the mediation system was created and its advantages. Thus, we propose that the mediation committee should be a nongovernmental organization, which specializes in mediating civil disputes under the grassroots government′s direction, and the legal mediation agreement should be endowed with the force of law.更多还原
