【摘要】 信用与担保相互依存,信用是担保存在的前提,担保是信用的保障,并在一定程度上促进信用;二者似乎又是此消彼长的关系,信用本质上不需要担保,而担保又说明信用已不足而论。对信用和担保的含义以及二者的关系略作剖析,并指出二者没有实现良性互动症结之所在,以期对信用和担保制度的研究和立法有所裨益。更多还原

【Abstract】 Credit and guarantee depend on each other, for credit is the premise of guarantee, and the latter can not only ensure the former but also promote it to some extent. On the other hand, the two seem to be antinomy. Credit doesn’ t need guarantee in essence, while guarantee means that credit is too bad. This article anatomises the meanings of credit and guarantee, points out the relations between them, and indicates why they have not realize mutual promotion so as to benefit the research and legislation on the credit and guarantee system.更多还原
