【摘要】 行政听证制度在中国应用的范围越来越广,所起的作用也十分明显。但是,目前中国行政听证制度也存在一些严重的不足。因此,应该扩大行政听证制度的适用范围;赋予听证会主持人以中立、客观的地位,保证听证活动公正、公平;应该公开、公正、合理地选择听证代表;听证结果应该对行政机关作出行政决定具有约束力;应该制定全国较为统一的听证程序。更多还原

【Abstract】 In China, the administrative hearing system has been applied in a wide scope and has exerted a marked influence. However, there still exist some serious inadequacies within this system at present. Therefore, measures should be done to enlarge the applicable scope of such system; to endow the host in hearing with a neutral and objective position, and ensure that the hearing is just and fair; the representatives at the hearing should be chosen under the principles of openness, justice and reasonableness, the results of the hearing should have binding force on the decisions made by the administrative organs, and we should also establish a nationwide unified hearing procedure.更多还原
