【Abstract】 The revision of the Criminal Code of 1997 to crime of acceptance of company or enterprise personnel affects the understanding of connotation and significance of the crime, the objective elements of which need particular reviewing. The crime of acceptance of company or enterprise personnel violates not only the order of fair competition and transaction, but also the probity of company or enterprise personnel. The objective aspect of the crime is the act that company or enterprise work personnel, in case(s) involving relatively large amounts, makes use of his or her job opportunity to demand property from others, or illegally receives others property in exchange for benefits, or in the course of economic contacts, receives personal kickbacks and commissions in various forms in violation of state rules.更多还原
