【摘要】 所谓行业协会 ,从本质上说 ,是同行业企业为减少交易成本而达成的妥协。组织上自治 ,经济上独立 ,活动上自由 ,地域上开放 ,是行业协会存在的基石。行业协会具有行业协调、行业代表、行业调解、行业服务等经济价值 ,同时对政府职能转变、建立法治国家和诚信社会有相当的价值。现有的行业协会法律调整和管理体制已严重阻碍行业协会应有价值的发挥 ,亟待新的法律调整并在此基础上重构行业协会。更多还原

【Abstract】 The essence of industry associations is that the same industrial firms reach an agreement to reduce transaction costs. The exist foundation includes organization of autonomy, finance of independence, freedom of behaviour, and opening of area. Not only do the industry associations play important role in coordination, representative, reconciliation and service, but also show social value in changing the government function, rule of law and credit society. Using law and govern to industry associations have critically hinder them playing role, so we need new legislation to reconstracte them.更多还原
