【摘要】 中国法制建设陷入了价值或曰“精神”迥异的中西法律文化冲突之中,基于文化的承续性、行为模式的特定性以及普适性知识存在的有限可能性,应以中国传统法律文化中的基本价值为基础,用西方文化的一些普适性价值对其进行修正,并将社会形态变迁的因素考虑进去,重塑一个剔除了封建因素的中国法律文化,作为现代法治社会建设的根本。承载价值和制度理论的实施制度应当符合“趋利避害”的人性原则,体现法律经济学的“利益最大化”原则,用微观制度的合理可行性来实现宏观价值。更多还原

【Abstract】 China’s construction of legal system is deeply entrapped by tremendous conflicts between Chinese traditional and western legal cultures. Given the continuum of culture, the specific nature of conduce modres and limited possibih’ty of the appliance scope concerning universal knowledge,and also on the basis of essential values in traditonal legal culture, the author has rectified some universal values originated from western civilization with equal attention to changes in social pattern. By so doing,the author has restructured China s legal culture,making it largely exempt from feudal elements,and establishing it as the fundamental of China’s construction of rule of law. Legal systems should comply with social values: it should conform to the principle of humanity characterized by pursuance of interests and avoidance of detriments as the maximum of interests in legal - economics. Above all, feasible and concrete micro - systems should be formulated to achieve social macro - values.更多还原
