【摘要】 深圳实施法定图则制度 ,是推进城市规划民主化与法制化的一项重要改革 ,在取得显著成效的同时 ,也遭遇到许多困难和问题。本文所列举的一个申请修改用地条件的案例表明 ,法定图则在运行中可能会面临图则违反法定权益、公众参与效果不佳、规划部门职责不清、规划委员会的决策与监督机制不健全等方面的问题 ,而这些问题产生的根源不在于法定图则制度本身 ,而是由于宏观经济和政治环境的影响、法定图则自身定位的矛盾性并受到目前规划技术手段和方法的制约。因此对于法定图则目前能够发挥的作用应有一个客观清醒的认识。改进和完善法定图则仍有大量的工作要做。论文最后介绍了深圳最近在完善法定图则的操作规则和技术体系等方面所做的努力更多还原

【Abstract】 The practice of statutory map system in Shenzhen is an important reform to promote democracy and legislation in urban planning. It is successful while with some difficulties. This paper introduces the efforts made by Shenzhen to improve the statutory map system in operating regulations and technology system. A application for revising the statutory map is cited in this paper, which reveals that there are problems and obstacles in promote this system, such as less desired effect of public participation, violating the property rights by implementing the statutory map, the blurred responsibility of planning administration, the imperfect decision making and supervision mechanism etc. The authors think that the roots of these problems are not coming from the statutory map system itself but from the macro political and economic environments.更多还原
