【摘要】 作为一项基本人身权利,公民健康权理应得到国家的保障。但受经济发展水平、医疗资源有限性和公民健康权扩张性的制约,国家只能通过基本医疗保险提供基本医疗保障,保证公民基本健康权得以实现。在此过程中,国家要确定合理的医疗保险水平,把公民基本健康权的扩张限制在合理的范围内,合理配置有限的医疗资源,并逐步扩大医疗保险范围,规范医疗行为,既保障公民的基本健康权,又限制其不合理扩张。更多还原

【Abstract】 Citizen’s health right ought to get the guarantee of the country as a basic personal right. But received the restriction of economic development level, limited medical resource and the expansive nature of citizen’s health right , the country can only offer basic medical treatment to guarantee citizen’s basic health right through the basic medical insurance. In this course, the country should define the rational medical insurance level, limit the expansion of citizen’s basic health right within the range of rational one, dispose the limited medical resources rationally, expand the medical insurance coverage progressively, and normalize the medical behavior.
