【摘要】 驰名商标确认制度是我国驰名商标特殊法律保护制度的基础，确立和完善统一的驰名商标确认制度是我国商标法制建设中面临的一项迫切任务。本文认为，在驰名商标确认标准上，应坚持内部标准和外部标准相统一的客观标准；在确认机关上应实行“二元制”，由人民法院和商标局分别行使驰名商标确认权，不宜由商标局单独确认；在确认方式上，实行申请确认（即显名主义）和纠纷确认（即隐名主义）两种作法。更多还原
