【摘要】 本文研究了迁徙自由的内涵及历史发展.比较分析了外国宪法和国际人权公约中有关迁徙自由的规定。作者认为：迁徙自由是劳动力资源得以合理配置的前提条件，是市场经济发展的内在要求。文章还从我国的国家性质、公民个人素质、人口：无动状况以及法律体系的内容等诸多因素分析了现阶段确立迁徙自由在我国宪法中地位的必要性和迫切性，建议修改我国现行宪法第39条。同时．制定、完善有关立法，保证公民正确行使迁徙自由。更多还原

【Abstract】 This article discusses the connotation and the historicnl development of free dom of movement, and analyses comparatively the clauses contained in the constitutions of foreign countries and international covenants on human rights. In the author’s opinion. freedom of movement is a premise of the rational disposition of labour resources .and also an inherent requirement of a market economy.
