【摘要】 中国30年的改革开放逐渐与世界相融合,并成为全球经济体系的一部分。全球化进程与市场化改革对中国的劳资关系产生了深刻的影响。经济全球化为中国造就了新的产业大军,并为劳资关系带来了结构性变化。它带动了一系列以出口为导向的产业的发展,促进了劳动力的流动,使大批中国农民从土地的束缚中解放出来。与此同时,经济全球化也带来了资本主义的游戏规则,它在创造财富的同时创造着新的社会关系;它在创造新的就业机会的同时也使一部分工人的权益受到侵害。中国加入WTO以后,由于利益格局的剧烈变动,劳动争议所带来的劳资对抗和矛盾愈加突出;国际劳工标准与中国国内劳动立法的冲突也在增加。为贯彻落实科学发展观,确保劳资关系和谐与社会稳定,中国加快了劳动立法的进程,《劳动合同法》的颁布实施标志着我国劳动管理体制迈出了关键性的一步。本文以经济全球化下的劳资关系为外生变量,以《劳动合同法》颁布实施为内生影响因子,厘析中国劳资关系的问题与走向,探寻从矛盾走向合作互利的共赢路径。更多还原

【Abstract】 After 30 years reform and opening-up , China has been integrating into the world and becomes a part of world economy. Globalization and marketization has profound influence on China’s labor-capital relations. Economic globalization brings up new workforce and changes labor-capital relations structurally, which drives a series of export-oriented industries developing and workforce flowing. A flood of Chinese peasants are released from the bondage of land. At the same time, economic globalization brings capitalist game rules. It creates not only fortune but also new production relations, not only new employment chances but also damage to a part of workers’ rights. After joining WTO, with acute changes of benefits pattern, labor-capital confronting and conflicts arose by the labor disputes have been more and more stand-out. The conflicts between international labor regulation and China’s labor laws have been increasing. To carry out scientific outlook of development and insure labor-capital harmonious relations and stable society, China quickens the process of legislation of labor laws. Issue and implementing Labor Contract Law symbols China’s key advancement of labor administration system. With labor-capital relations under globalization as exogenous variable and issue and implementing Labor Contract Law as endogenous variable, this article analyzes the problems and trend of labor-capital relations in China, seeks the way to solve the conflicts, cooperate and achieve mutual benefits.更多还原
