【摘要】 构建和谐社会是当代中国的主旋律。法治的和谐是和谐社会的应有之义和逻辑前提。和谐社会并非是没有纠纷的社会。纠纷是社会的常态,也是社会赖以存在之规则产生与运作的起点。这个判断对于作为社会下位概念的和谐社会也是当然成立的。只是在和谐社会中,人们更加注重纠纷的最终解决(而非仅仅是判断是非),因此纠纷的解决机制应当更加体现自治与和谐的精神,这与现代社会纠纷解决机制的发展方向是相契合的。现代社会的纠纷解决机制是经历“替代的司法”与“司法的替代”而形成的以诉讼解纷为中心的包含非诉讼解纷的多元有机体系。纠纷解决机制如何设置直接关涉到社会纠纷与冲突的控制、社会主体权利的实现与社会秩序的稳定与发展。纠纷解决机制作为法治秩序的核心环节,其合理配置对于保障个体的权利、维护社会秩序和促进社会和谐具有重要价值。建立多元化的纠纷解决机制,实现诉讼内外的各种纠纷解决机制的功能互济、有机衔接与整合是建立社会主义和谐社会的内在要求。更多还原

【Abstract】 Harmonious Society Construction is the main rhythm in current China. Harmoniousness of rule of law is the inherent meaning and logic premise for harmonious society.However, there are disputes in harmonious Society. Dispute is the normal phenomena in any society and the jump-off point which produces and operates social essential rule. So is the harmonious society because it is the subordinate concept of society. But dispute settlement mechanism should embody the autonomic and harmonious spirit much more since people pay more attention to settle dispute rather then judge right and wrong in the harmonious society. Compared with the developing process and result of modern dispute settlement mechanism, the result is the same. Modern dispute settlement mechanism is a plural and organic system which attaches most importance to litigation but includes non-litigation through“alternative justice”and“justice alternativeness”.How we set up dispute settlement mechanism directly determines social dispute and conflict control, social subject’s right realization, social order substitution, development and stabilization. Dispute settlement mechanism is the order core of rule of law. Deploying dispute settlement mechanism in reason will ensure individual right, maintain social order and advance social harmoniousness. Building plural dispute settlement mechanism, making them functionally reciprocal, organically linked and integrated, is the inherent logic of building harmonious socialism society.更多还原
