企业商业标记权法律保护问题研究

【摘要】 商业标记包括商标、商号(字号、厂商名称)、地理标志、域名、产地标记、知名商品特有名称、包装、装璜及商业广告短语、企业徽标等。企业商业标记权是企业基于商业标记而拥有的各种法定权益的统称，是企业知识产权或工业产权的重要组成部分之一。本论文重点探讨的是市场影响范围最广和凝结财产价值最大的四大企业商业标记即商标、商号、地理标志和知名商品特有标识的权利法律保护问题，特别是法律保护的热点和难点问题，以及商业标记之间权利冲突的法律对策问题。 本论文由相对独立却密切不可分割的两大部分、9章内容构成。第一部分，即总论部分，亦即第1章——第3章，这部分主要内容是：(1)概述了商业标记的概念、类别范围、区别与特征、功能与价值以及商业标记的起源和制度演变；(2)简要论述了商业标记权的概念、特征以及其权利的取得、归属和终止；(3)综合论述了商业标记权法律保护的价值目标、保护途径、保护现状。第二部分，即分论部分，亦即第4章——第9章，这部分主要内容是：(1)分别论述了各类商业标记权利的法律保护问题，其中商标权(第4章)、商号权(第5章)、地理标志权(第6章)、知名商品特有标识权(第7章)这四大商业标记权的法律保护问题作了重点论述；商业域名、企业徽标、商业广告短语、产地标记、质量标记五标记的法律保护问题在第8章作了简要论述；(2)第9章主要探讨了商业标记整体性法律保护模式问题，提出了建立商业标记一体化法律保护模式的构想。 本论文的创新之处主要体现在如下几方面：(1)对商业标记作了更多还原

【Abstract】 Commercial mark contains trademark, enterprise name, geographical indication, domain name in network, symbol of product region, specific mark for famous goods, package, advertising phrase and enterprise symbol etc. The right of commercial mark is a kind of general legal right for commercial mark and an important part of industrial property. This essay emphasizes on legal protection of four commercial marks with deepest market influence and greatest property value, that is trademark, enterprise name, geographic indication and specific mark for famous goods, especially focuses on hot and difficult issues for protection and how to resolve conflict among commercial mark rights.This essay consists of two parts and nine chapters. The main content of the first part—general part including chapter 1 to chapter 3 are as follows: (1) Generally describe the definition, category, distinction and characteristic, function and value, origin and development of commercial mark; (2) Expound the definition, trait, start-up, owner, termination of the right of commercial mark; (3) Analyze the goal and value, approach and present situation in legal protection for right of commercial mark.
