【摘要】 对案件事实的真实性究竟应该怎样理解和把握不仅是困惑司法实践的难题,也是法学理论研究应当面对和解决的课题。本文在吸收和借鉴当代哲学、逻辑学、历史学关于真实性认识的有关理论和研究方法的基础上,对案件事实真实性的基本理论问题进行了法哲学层面上的探讨,是从“真”的视角对案件事实及其形成过程的法理解读。在坚持以辩证唯物主义认识论为指导的前提下,运用语义分析和逻辑分析方法对案件事实真实性进行了语义上的界定和逻辑命题意义上的分析,指出案件事实是以真实性为基础和核心的人的认识和判断的产物。作为司法证明与认定的产物,本文还从案件事实的证明与认定的过程上进行了真实性分析,指出案件事实的证明及认定是围绕着真实性进行的。文章最后对正义、效率和人权等法的价值与案件事实真实性之间的关系进行了论述,认为在案件事实的探知过程中真实性并不是惟一的和最重要的价值,案件事实是一个以真实性为基础的法的诸多价值平衡的产物。更多还原

【Abstract】 The main function of judicature is to solve conflicts justly while truth of judicial fact is the precondition of the justice of judicial judgment. The dissertation is to analyze the understanding of truth of judicial fact, the relationship between truth of judicial fact and human’s judgment, legal system, and other values in theory. The whole paper that is composed of five chapters covers the general theories of truth of fact, the definition of truth of fact, the standards of truth of fact, the relationship between the elements in forming judicial fact and truth of judicial fact, the relationship between legal values and truth of judicial fact.Chapter One The general theories of truth of fact. Firstly, the author makes a semantic distinction between“fact”and“truth”, and points out that“fact”and“truth”are not only concepts in the ontological sense but also concepts in the epistemological sense. In the epistemological sense,“fact”means judgment proposition and“truth of fact”shows that“fact”is concept of judgment proposition of truth and“truth”is attribute of judgment of“fact”. On the concrete analysis of the relationship between“truth”and epistemology, the author believes that“truth”only appears when there is a necessity of justification, and further makes an analysis of the theories such as correspondence theory of truth of the justification of truth of fact. In the discussion of the standard of truth, the author examines the ideas of different philosophical approaches on this issue, points out that the standard of truth is the standard of proof of truth in substance, and practice is a means for judgment.
