【摘要】 刑事程序的价值问题是刑事诉讼法学领域最具方法论意义的基本理论问题,本文对这一基本理论问题进行了系统而全面的初步探讨。 全文共分为七章,在对刑事程序价值论的主要范畴进行明确界定的基础上,具体论及刑事程序的价值要素、价值构成、价值目标、价值选择、价值评价和价值重建。其中,前四章主要涉及刑事程序价值的基本理论,后三章则是以刑事程序价值基本理论为指导的实证分析。在后三章中,第五、六章是对我国刑事程序的价值选择和价值评价;第七章则是以价值选择和价值评价为基础的价值重建。 各章主要内容如下: 第一章重在廓清刑事程序价值论最基本的概念。 刑事程序价值是刑事程序法学理论中的一个基本范畴,刑事程序价值不仅在理论研究中具有基础作用,而且对刑事程序的立法与司法活动也具有指导意义。正是基于对刑事程序价值这一基础理论之重要性的认识,笔者认为,无论从哪个角度来建立刑事程序的价值理论体系,研究者都必须首先对“价值”的一般含义作出回答。在这个问题上,笔者赞同当今哲学价值学界的主流观点,即价值在本质上是主客体之间的一种需求与满足的关系,在现象上表现为客体得以满足主体的诸种属性。刑事程序价值则是哲学价值在刑事程序领域的具体反映,它存在于一定的主客体互动关系之中,是作为客体的刑事程序满足作为主体的“人”对其提出的不同需要而具有的种种内在属性。在此基础上,笔者进一步阐述了刑事程序价值这一基本范畴在刑事诉讼法学研究中的重要意义,其中又着重阐述了它与刑事诉讼法学领域其他几个主要范畴之间的辩证关系。 第二章主要论述刑事程序价值的内在要素,即刑事程序价值的主体、客体和它们之间的价值关系。 刑事程序的价值主体、价值客体以及二者之间的价值关系构成刑事程序价值的三大要素。其中,刑事程序的价值客体就是刑事程序本身,主要包括审前程序、审判程序、救济程序和执行程序;刑事程序的价值主体是指参与刑事诉讼,通过影响刑事程序的实际运行以满足自身利益需要的个人或者组织。如果说价值主体和价值客体是刑事程序价值的两个端点,那么主体与客体之间的价值关系就是联系这两个端点的桥梁。刑事程序价值关系在形式上表现为主客体之间的需要与满足的价值依赖关系,在实质上体现为一种主客体之间的价值创造关更多还原

【Abstract】 The value of criminal procedure is the basic problem in the field of process science. In this thesis, the author will treat this subject tentatively.This thesis consists of seven parts, involving the essential factor of the criminal procedure, together with the value structure, the value aim, the value election, the value appraise and the value reconstruction. The former four parts deal with fundamental theory. And the later three parts deal with the positive analysis.The following is the main content of this thesis:The first section deals with several basic concepts. In this part, the author firstly defined the notion of Value. From this on, the notion of process value was further defined, which shows as those features of the process to satisfy the subjects’ wants. Then, on this base, the author made a clear definition between process value and other concepts.The second section deals with the essential factors of process value. In this part, the author clarified the subject, the object and the relation between them. Among these three factors, the subject equals to man and some other organizations. The object equals to criminal process and its secondary links. And the value relation expresses the dependent and creative relation.The third section deals with the value structure of criminal process. In this part, the author insisted that the value of criminal procedure consist of three layers, which show as the aim value, the instrument value and the social value. Among them, the aim value is the inner value of criminal procedure, which lies in the nature characteristics of criminal procedure. The instrument value is the function to serve as an instrument to achieve some real purposes. The social value is the common values of the whole laws.The forth section deals with the value aim of criminal procedure. In this part, the author hold that there were three layers of the process value aim, and expounded the different value aims of the criminal procedure. That is, the basic value aim, which equals to the truth, the essential value aim, which equals to the justice, and the realistic value aim, which equals to the efficiency.The fifth section deals with the value election. In this part, the author made a comparative between the different value and value aim, and supplied respective standard of value election.The sixth section deals with the value appraise. In this part, the author made a deeply appraise on several main process, such as the pre-court process, the trial process, the simplified process and the relieve process.The seventh section deals with the value reconstruction of criminal process. In this part, the author analyzed the probabilities and the necessities of the value reconstruction of criminal procedure, and supplied a reasonable mode of such a reconstruction.In a word, the whole thesis is arranged according the thought logic of raising problem, analyzing problem and solving problem.更多还原
