【摘要】 国家与社会各自及两者间的互动性状态决定着现实中的法律的境况，国家只有扮演好自身的与社会在内在要求相适应的角色，才能使体现社会内在需求的法律适时而有效地产生、变革与发展；社会只有适度自立，才能使自身内在需求的法律通过国家这一中介而转化为现实中的法律。要揭示传统东方法律的运动机理，就应正视国家和社会各自及两者互动的影响。 本文以马克思主义经典作家对传统东方国家与社会各自及两者互动性特质的相关研究成果为主要理论资源，挖掘马克思东方社会理论中有关传统东方法律的运动机理的国家与社会制约因素的论述精华，立足于关注整个传统东方的社会变迁与国家角色定位及职能发挥的种种变化对法律发展的影响，从概括传统东方国家与社会的结构特征入手，系统阐述传统东方国家与社会各自特征以及两者间的内在关联，然后，研究传统东方国家与社会各自对法律发展的影响，阐述变革时代的东方所呈现的国家、社会与法律发展间的关系特征，并特以具有代表性的中、俄、印三国为例作个案分析，揭示了传统东方法律发展滞后于西方乃因忽视对社会力量作必要的关注以及相应引发的国家角色扮演的错位所致，勾勒出一幅传统东方法律在国家和社会所构成的矛盾体中的运动机理的图景。当然，法律发展又对社会变迁具有反作用，它不仅影响社会现实，而且在一定条件下能够成为左右社会历史发展进程的决定性力量。所以，要使得法律扮演好自身的角色，必须慎重处理好法律发展同社会变迁、国家角色的转换及两者互为一体之间的关系，准确把握法律的运动脉膊，充分发挥法律的应然功用。 中 文 摘 要 东方社会理论是马克思主义思想体系的有机构成部分，而就传统东方法律的运动机理的阐述又是马克思东方社会理论的重要方面，认真研究、理性分析和精准把握马克思主义经典作家的思想、理论精髓，对当下中国在认清传统、直面现实、展望未来的基础上，推进法制现代化的历史进程具有十分重要的理论和实践指导意义，而目前学界尚较少涉足这一领域。传统蕴含着现代，预示着未来，只有接续传统东方法律文化历史发展的足迹，才能把握中国法制现代化的内在逻辑机理，才能使当今和未来中国法制现代化沿着历史发展的内在规律前行。更多还原

【Abstract】 The condition of realizable law is determined by the respective and mutual conditions of country and society. The country can make the law embodying social internal requirement emerge, change and develop effectual, timely only if it can play the role meeting with social internal requirement. The society can transfer the law required by society into the realizable law by country, the medium only if the society depends on itself. In order to expounding the movement mechanism of traditional oriental law, we should face squarely the respective and mutual influence of country and society.The theoretical base of this dissertation is research result on traditional orient countries and societies respective and mutual character of Marxian principal writers. This dissertation excavated out the essences of discussion on restricted factor of country and society about "The Movement Mechanism of Traditional Oriental Law" in Marxian Orient Theory. This dissertation rooted in concerning whole influence produced by change of society and countries role and function on development of law. This dissertation firstly sets about to summarize the social structure character of traditional orient country and society and systematic discuss respective character and internal relationship between traditional orient country and society. Then we will do research on influence of law’s development come from traditional country and society respectively, the relationship among oriental counties, societies emerging in change time and laws will be discussed, and we specially use three representative countries China, Russia, India as good examples. The dissertation reveals that the ignorance of social powers is the reason that traditional orient law is lagging to the west and,on the other hand, was out line of picture about the movement mechanism of traditional orient law in contradiction composed by country and society. Without doubt, law development has opposite reaction to change of society. It not only influences social realitybut also in certain condition, can be decision - making power which can control society development. So, in order to make the law act as a good role itself, we should cautiously deal with the relationship between law development and society change, countries role transform and their two - in - one relationship, we can grasp firmly the pulse of law movement and elaborate law’s applied function.The Oriental Sociological Theory is one organic component of ideology system of Marxism. The discussion on "The Movement Mechanism of Traditional Oriental Law" is the important aspect of Marxism’s Oriental sociological Theory. We should seriously research and firmly grasp the essence of the theory. Nowadays, it has a significant theoretical and practical meaning for promoting the history progress of legal modernization. But now, there are few research and discussion on this academic area. Tradition embraces modern and foretells future. Following the developing track of Traditional Oriental Law, we can grasp the internal logic mechanism of the Chinese legal modernization, and promote the Chinese legal modernization through the internal rule.更多还原
