高校教师聘用合同争议问题研究

【摘要】 从上世纪八十年代,我国开始了教育制度的改革,教师的身份制度也在不断变化,高校对教师的管理从之前的身份关系转为契约关系2014年国务院颁布了《事业单位人事管理条例》,该条例的出台意味着事业单位此后以聘用制为核心的人事制度逐步形成而在法律上,目前没有任何一部法律明确了高校教师聘用合同属于何种法律性质,也没有明确高校教师所属法律地位,导致在实际履行合同过程因法律适用的混乱以及司法裁判不一出现了很多纠纷与争议。本文试图在分析聘用合同性质的基础上,通过中国裁判文书网,找到所需要的样本案例,利用这些案例找出目前高校教师聘用合同争议的类型,分析目前高校教师聘用合同争议的主要难点所在,再在此基础上分析法院目前对上述难点的审判意见。最后通过这些争议案件提出自己的观点与建议。本文的主要内容如下:第一章是对高校教师聘用合同的概说。首先对聘用合同的定义开始界定,通过对聘用合同的定义与特点的分析,来界定聘用合同的概念。再对目前学界对于聘用合同性质产生的不同观点进行归纳总结来分析聘用合同的法律性质,最后分析目前我国高校教师聘用合同的立法现况。第二章是对高校教师聘用合同的案件争议类型的研究。首先通过裁判文书网搜集样本案例,介绍本文对样本案例的搜集方式以及过程,再对搜集到的样本案例进行数据分析,通过这些数据得到目前高校教师聘用合同的争议主要的类型,然后再由这些不同的类型展开对聘用合同争议过程中的主要难点的分析,最后归纳法院对高校教师聘用合同争议过程中这些难点的审判意见。第三章是关于高校教师聘用合同争议问题的具体完善建议,在前两章的基础上分析总结,并从立法与司法的角度,提出具体合理的完善建议与措施。

【Abstract】 Since the eighties of last century,our country began the reform of the educational system,at the same time,teacher’s identity system is constantly changing,the management of teachers in colleges and universities changed from the previous identity to the contractual relationship.In the year of 2014,the promulgation of the State Council’s "Regulations on the Administration of Personnel in Institutions" meant that the personnel system with the employment system as the core has gradually taken shape.However,in the law system,we cannot find a law that clearly defines the legal nature of employment contract of college teachers,or clearly define the legal status of college teachers,leads to the fact that there are many disputes arising from the legal application of the contract and many judicial controversies.Based on the analysis of the nature of the employment contract,this paper acquired sample cases by collecting written judgement on China Judgements Online,attempts to find out the sample cases needed to find out the types of disputes over employment contracts and to find out the main difficulties in the employment contract dispute among college teachers,and analysis the Court’s current trial above those difficulties.Finally,through these controversial cases put forward views and suggestions.The main contents of this article are as follows:Chapter one summarizes the employment contract of college teachers.Based on the definition of employment contract of college teachers,analyze the concept and definition of employment contract to define the concept of employment contract.Then the current academic circles summarize and summarize the different perspectives on the nature of employment contract and analyze the legal nature of employment contract.Finally,current legislation of employment contract of College Teachers in China.The second chapter is about the types of disputes over the employment of college teachers.Firstly,we collect sample cases through the China Judgements Online,introduce the ways and processes of collecting sample cases,and then analyze the collected sample cases.Through those data,we can get the types of disputes about the contract of college teachers,and then analyze the main difficulties in the process of employment contracts,finally summed up the courts judicial explanation of these difficulties of college teachers’ employment contract.The third chapter is a concrete suggestion on the controversial issue of employment contract of college teachers.Based on the two chapters,from the perspective of legislation and judicature,propose concrete suggestions and measures for improvement.
